1. Acceptance of Terms

By accessing or using CWriting ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. These terms form a binding legal agreement between you and CWriting, governed by the laws of Canada and the applicable provincial laws.

2. Description of Service

CWriting is an AI-powered writing practice platform designed to help users prepare for the CELPIP English language exam. The Service provides automated feedback and scoring on writing submissions using large language model (LLM) technology. CWriting is not affiliated with, endorsed by, or connected to Paragon Testing Enterprises or Immigration, Refugees and Citizenship Canada (IRCC). CELPIP® is a registered trademark of Paragon Testing Enterprises.

3. Service Provided As-Is

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • AI-generated feedback will be accurate, complete, or reflect official CELPIP scoring standards.
  • Use of the Service will result in improved exam scores or exam success.
  • The Service will be uninterrupted, error-free, or free of harmful components.
  • Any particular outcome, result, or recommendation will be suitable for your circumstances.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, CWRITING AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY:

  • Direct, indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or other intangible losses.
  • Damages arising from reliance on AI-generated feedback or scores.
  • Damages resulting from exam failure, visa application outcomes, or immigration decisions.
  • Service interruptions, data loss, or security breaches beyond our reasonable control.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) CAD $50 OR (B) THE AMOUNT YOU PAID TO US IN THE 30 DAYS PRECEDING THE CLAIM.

5. No Refunds

All purchases are final and non-refundable. See our Refund Policy for full details.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Reverse engineer, scrape, or reproduce the Service or its AI outputs for commercial purposes.
  • Submit content that is harmful, offensive, or infringes third-party intellectual property rights.
  • Attempt to circumvent credit limits, access controls, or payment systems.
  • Share, resell, or redistribute your account or credits to third parties.

7. Intellectual Property

All content, branding, UI design, and underlying software of CWriting are owned by or licensed to CWriting. AI-generated feedback delivered to you is licensed for personal, non-commercial use only. You retain ownership of the essay text you submit.

8. Account Termination

We reserve the right to suspend or terminate your account at any time for breach of these terms, fraudulent activity, or abuse of the Service. No refund will be issued upon termination for cause.

If you wish to close your account voluntarily, email us at support@celpipwriting.com with the subject line "Account Closure Request." We will delete your account and associated personal data within 30 days. Any unused credits or subscription time are forfeited upon closure - no refunds will be issued.

9. Modifications to the Service and Terms

We may modify or discontinue the Service, or amend these Terms, at any time with or without notice. Continued use after any modification constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Canada and the province in which CWriting operates, without regard to conflict-of-law principles. Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in Canada.

11. Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and CWriting regarding the Service and supersede all prior agreements.
